Terms of Service

1. Acknowledgement

This End-User License Agreement ("EULA") is concluded between you and Stiletto AI only, not with Apple. Stiletto AI is solely responsible for the Licensed Application and its content. This EULA complies with the Apple Media Services Terms and Conditions.

2. Scope of License

The license granted is limited to a non-transferable license to use the Licensed Application on any Apple-branded Products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. The Licensed Application may be accessed via Family Sharing or volume purchasing by other accounts associated with the purchaser.

3. Maintenance and Support

Stiletto AI is solely responsible for providing maintenance and support services for the Licensed Application. Apple has no obligation whatsoever to furnish any maintenance and support services.

4. Warranty

In the event of any failure of the Licensed Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price. To the maximum extent permitted by law, Apple will have no other warranty obligation, and any other claims, losses, liabilities, damages, costs, or expenses will be Stiletto AI's sole responsibility.

5. Product Claims

Stiletto AI, not Apple, is responsible for addressing any claims relating to the Licensed Application or your use of it, including but not limited to: (i) product liability claims; (ii) any claim that the Licensed Application fails to conform to legal requirements; and (iii) claims arising under consumer protection, privacy, or similar legislation.

6. Intellectual Property Rights

In the event of any third-party claim that the Licensed Application or your use of it infringes intellectual property rights, Stiletto AI, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of such claim.

7. Legal Compliance

• You represent and warrant that:
• You are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country
• You are not listed on any U.S. Government list of prohibited or restricted parties

8. Subscription and Payments

• Subscriptions are managed through App Store
• Subscriptions are personal and non-transferable
• Subscription fees are non-refundable
• You can cancel your subscription anytime through App Store settings
• Pricing may change with prior notice
• Payment processing follows App Store guidelines

9. Photo Usage and AI Services

• You may only upload photos you own or have rights to use
• Inappropriate, obscene, or illegal content is prohibited
• Photos are processed by FASHN AI and OpenAI services
• Generated images are saved only to your device gallery
• No cloud storage of your photos
• AI service results are advisory in nature
• No guarantees are provided for style transformation results

10. Data Storage and Privacy

• No authentication or account required
• All data is stored locally on your device
• You are responsible for managing your device storage
• No cloud database storage
• No personal data collection beyond app functionality requirements

11. Usage Restrictions

• The app is for personal use only
• Commercial use is prohibited
• Automated access is not allowed
• Attempting to bypass restrictions is prohibited
• The app must be used in compliance with all applicable laws
